1. Introduction

These Terms and Conditions ("Terms") govern your use of the PitchKill website and services located at pitchkill.com ("Service"), operated by Mosaik Digital Kft. (Tax number: HU27491560, Registered seat: 1126 Budapest, Királyhágó utca 5/A 3. em. 1B. ajtó), a company registered in Hungary ("Company", "we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

PitchKill is an AI-powered startup idea analysis platform. The Service provides:

  • Free Score: AI-generated composite score, a verdict (BUILD, VALIDATE FIRST, PIVOT, or KILL), fatal flaw identification, competitor overview, and a brief roast of the idea.
  • Full Deep-Dive Report (Free): A comprehensive PDF report including 12-month financial model, full competitor analysis, validation sprint checklist, risk matrix, and technical feasibility deep dive. Delivered to your email.

3. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement.

4. User Accounts and Access

The Service does not require account registration. Access to analysis results is managed through unique client tokens generated at the time of submission. You are responsible for safeguarding your result links and download tokens.

We reserve the right to limit usage to 5 free analyses per IP address per 24-hour period to prevent abuse.

5. Intellectual Property

5.1 Your Content

You retain 100% ownership of the startup idea description you submit ("User Content"). We do not claim any intellectual property rights over your User Content. We do not share, publish, license, or use your User Content for any purpose other than generating your analysis.

5.2 Analysis Output

All analysis results, reports, scores, financial models, and other outputs generated by the Service based on your User Content ("Analysis Output") belong to you. You may use the Analysis Output for any lawful purpose, including pitch decks, investor conversations, internal planning, and publications.

5.3 Our Intellectual Property

The Service itself — including the website design, logos, scoring methodology, agent architecture, code, and branding — remains the exclusive property of Mosaik Digital Kft. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as described herein.

6. Service Delivery

6.1 Pricing

The Service is currently offered free of charge. We reserve the right to introduce paid features in the future, with advance notice.

6.2 Report Delivery

Full reports are generated and delivered to the email address you provide. Download links are valid for 7 days from the date of delivery. If you experience issues accessing your report, contact us at the email provided in Section 15.

7. Data Collection and Privacy

7.1 What We Collect

When you use the Service, we collect the following:

  • Startup idea description — the text you submit for analysis (required, 50-2,000 characters).
  • Email address — only if you choose to provide it for report delivery.
  • IP address — used solely for rate limiting and abuse prevention.
  • Client token — a randomly generated identifier for secure result retrieval.
  • Browser fingerprint — a non-identifying hash used for rate limiting.

7.2 How We Use Your Data

  • To generate and deliver your analysis and reports.
  • To enforce rate limits and prevent abuse.
  • To send you the report you requested via email.

7.3 What We Do NOT Do

  • We do not sell your data to third parties.
  • We do not display advertisements.
  • We do not share your idea or analysis with third parties.
  • We do not use your submissions to train AI models.
  • No humans read your idea — analysis is performed entirely by AI.

7.4 Third-Party Services

The Service uses the following third-party providers to operate:

7.5 Data Retention

Analysis results are retained in our database so you can return to them. Download links for reports expire after 7 days. If you wish to have your data deleted, contact us at the email provided in Section 15, and we will remove your data within 30 days.

7.6 GDPR Rights (EU/EEA Users)

If you are located in the European Union or European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):

  • Right of Access — request a copy of the personal data we hold about you.
  • Right to Rectification — request correction of inaccurate data.
  • Right to Erasure — request deletion of your personal data.
  • Right to Restrict Processing — request limitation of how we process your data.
  • Right to Data Portability — receive your data in a structured, machine-readable format.
  • Right to Object — object to certain processing of your data.

To exercise any of these rights, contact us at the email provided in Section 15. We will respond within 30 days.

The legal basis for processing your data is: (a) contractual necessity — to provide the Service you requested; and (b) legitimate interest — for rate limiting and abuse prevention.

8. AI-Generated Content Disclaimer

All analysis, scores, verdicts, financial models, competitor data, and recommendations provided by the Service are generated by artificial intelligence and are provided "as is" for informational purposes only.

Specifically:

  • The Service does not constitute business, financial, legal, or investment advice.
  • AI-generated analysis may contain inaccuracies, outdated information, or errors.
  • Competitor data and market size estimates are AI-generated approximations, not verified facts.
  • Financial projections are hypothetical models, not guarantees of future performance.
  • A "BUILD" verdict does not guarantee business success; a "KILL" verdict does not guarantee failure.

You should independently verify all information before making business decisions. We strongly recommend consulting with qualified professionals (attorneys, accountants, business advisors) before acting on any analysis provided by the Service.

9. Acceptable Use

You agree not to use the Service to:

  • Submit content that is illegal, defamatory, obscene, or infringes on the rights of others.
  • Attempt to circumvent rate limits or access controls.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.
  • Resell or redistribute the Service itself (you may freely use your own Analysis Output).
  • Impersonate another person or entity.
  • Interfere with or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate access for any user who violates these Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Mosaik Digital Kft. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not responsible for business decisions you make based on AI-generated analysis.
  • We are not liable for any loss of profits, data, business opportunities, or goodwill.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The results generated will be accurate, complete, or reliable.
  • Any defects in the Service will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mosaik Digital Kft., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

For material changes that significantly affect your rights, we will make reasonable efforts to notify users (e.g., via a notice on the website).

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law principles.

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.

If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any applicable purchase confirmations, constitute the entire agreement between you and Mosaik Digital Kft. regarding the use of the Service and supersede all prior agreements, communications, and understandings.
